Title: CDC's Core Data Use Agreement Approach: What is it and How Will it Work?

Description: In November 2022, CDC's Advisory Committee to the Director (ACD) detailed significant problems with the current landscape and structure of data sharing between state, Tribal, local, and territorial jurisdictions (STLTs), and issued recommendations for CDC to restructure data sharing. Data sharing between CDC and jurisdictions' health departments was previously governed by multiple, often duplicative, and sometimes contradictory data use agreements (DUAs), creating inconsistency across CDC programs and increased administrative burden for both jurisdictions and CDC. As demonstrated by COVID-19, the time to negotiate individual DUAs during emergency response inhibits timely analysis and decision-making. Additionally, these agreements did not account for technological improvements that speed up data exchange. In response to the ACD report, CDC's Office of Public Health Data, Surveillance, and Technology (OPHDST) worked with CDC leadership to create a new 'Core DUA' approach, in which CDC will have a single DUA with each jurisdiction, comprised of a single set of Common Provisions with addenda that further describe jurisdiction and data-specific requirements. The Core DUA approach aims to reduce the administrative burdens on all parties involved in DUA execution for data sharing and to provide common security and privacy protections for all core data (case data; syndromic surveillance data; vital statistics data; laboratory-based diagnostic test data; hospital capacity data; and vaccine administration data), with opportunities for CDC and jurisdictions to work together to amend and update as technological, legal, and jurisdictional contexts change over time. This approach will also enhance response readiness and offer opportunities to incorporate other data in the future. Jurisdictional collaboration is critical to ensure the Core DUA approach meets its multiple goals. The Core DUA approach will also allow CDC to work collaboratively with jurisdictions throughout the implementation of this new approach to improve data sharing relationships. This workshop will create a space for CDC and jurisdictions to speak candidly about the historical pain points of DUA execution and move to problem-solving by providing input on the Core DUA initiative. Health department attorneys and other staff involved in developing data use agreements and data-focused partnerships with CDC can respond to the approach, relate potential benefits and challenges, and discuss opportunities to align activities to ensure efficiency and sustainability. In the second half of the session, participants will review and comment on draft resources that are being developed to support the implementation of the Core DUA.
